2026 Learner Protections & Instructor Regulations

In February 2026, the NSW Government introduced a series of new regulations designed to protect learner drivers, improve the quality of driving instruction, and crack down on unlicensed instructors. If you are learning to drive or booking a test, here is what you need to know about the new rules.

The Crackdown on Unlicensed Instructors

Unfortunately, the driving school industry has seen a rise in unqualified individuals offering cheap, "guaranteed pass" lessons. These individuals often do not possess a Working With Children Check (WWCC), comprehensive dual-control insurance, or a valid Driving Instructor (DI) licence.

What has changed: Service NSW now mandates stricter identity and credential checks for all instructors presenting candidates for the practical driving test. If an instructor is found to be operating without a valid DI licence, the learner's test may be cancelled on the spot, and the learner forfeits their booking fee.

Mandatory Working With Children Checks (WWCC)

To protect young learners, all accredited driving instructors in NSW must hold a valid, verified WWCC. The 2026 updates have integrated this check directly into the instructor's licensing profile.

The "3-Lesson Minimum" for Overseas Conversions

This rule aims to reduce the high failure rate and ensure candidates understand local road rules, such as head checks and proper stopping procedures.

Enhanced Vehicle Roadworthiness Checks

Service NSW testing officers have tightened their pre-test vehicle inspections. If your vehicle (or your instructor's vehicle) has bald tyres, broken indicators, warning lights on the dashboard, or insufficient dual-control certification (for instructor cars), the test will be immediately terminated.
